I. Intentional Infliction of Emotional Distress - Prima Facie Case: 1. An act by defendant amounting to extreme and outrageous conduct; A. Misuse of Authority B. Known Sensitivity: If defendant knows that plaintiff is more sensitive and thus more susceptible to emotional distress thant eh average person. These rules may also apply where defendant's conduct is directed at individuals in certain groups such as children, pregnant women, and elderly people. 2. Intent on part of defendant to cause plaintiff to suffer severe emotional distress, or recklessness as to teh effect of defendant's conduct; A. Intentional Conduct B. Reckless Conduct 3. Causation; and 4. Damages - Severe emotional distress. A. Not necessary to prove physical injuries B. Severe Emotional Distress: more than a reasonable person could be expected to endure. *Barbri - Multistate 2011

3:26PM - New Life Goal
I have always had the dream of being rich, of being a millionaire. However, recently I came to the realization that I simply do not have the gumption to be a millionaire. I don't think I could ever take the risks necessary to become a millionaire. And besides, I understand that it is not money that makes us happy. I am quite comfortable with the idea of living my life with a family in the upper middle class realm as a hardworking, but not overworked attorney.
Instead, I have decided to create a new goal:
In my lifetime, starting today, I want to charitably give at least $1 million dollars, above and beyond my tithe to the church.
The ideas associated with giving so much money fill me with so much more joy than envisioning what I could do with my own millions. I am truly excited about this kind of giving and I pray that I reach my goal.
